Appeal of LGBT prisoners in Moldova

This month, the European Commission filed a lawsuit in the European Court of Human Rights against Hungary and Poland which, under the pretext of PROTECTING minors, ends up discriminating against LGBT people. Previously, similar protests concerned the Russian Federation and continues to do so until now. Nobody knows but there is another country in Europe that, under the pretext of PROTECTING minors, adopted a discriminatory law against LGBT people in 2013, to the delight of some fake human rights organizations seeking funding from abroad. This country is Moldova and this is the law number 43 of 22.03.2013, which we ask to be canceled. We are a group of LGBT inmates from one of the prisons from Moldova, but we are many others all over the country! We feel humiliated and helpless in this country which this year received candidate status for the European Union. Here the hierarchical system inherited from the Soviet era flourishes, which the state does not intend to eradicate and does not intend to implement any humanization of the cruel criminal legislation, probably the bloodiest in Europe. Our state does not listen to us! The president does not listen to us, Parliament does not listen to us, the government does not listen to us, human rights organizations do not want to listen to us, fearing for their reputation, which can be undermined by protecting us. If a journalist interviews us, he will write everything in a negative light, because the Moldovan society has only a negative opinion of what is related to our sexual orientation. Yes, some of us have been convicted of sex crimes, which is why the local LGBT community shuns us too, but firstly, many unfair sentences have been handed down in the last few decades and secondly, our sentences are not. I say this in terms of deprivation of liberty, we should be subjected to torture and we shouldn't have the option of an early release. And precisely because of the lack of trust in the judiciary, the country is facing a reform of the judiciary, which is unlikely to affect us. Our letters do not reach the legislators. All our appeals remain in the secretariat, from where they send us pre-prepared answers to any questions in the form of templates and clichés, changing only the names in them. Therefore, we ask you, as a person (organization) who, due to his status, has the possibility to reach our government, to make our appeal to him. It is not necessary to delve into the aspects of Moldovan jurisprudence, let the local lawyers take care of it, we just want to be heard! To give you an idea of ​​how we are treated, let's take the following example: Our prison doctor refuses to treat and fill the teeth of LGBT inmates, he only agrees to remove every newly sick tooth. After filing a complaint with the prison administration about the dentist, I received the reply that the dentist acts according to the medical program approved in 2007. But this program does not say that only LGBT inmates are not entitled to dental care because the equipment and tools cannot be used for LGBT inmates. You see, the authorities don't delve into the essence of our problems! We cannot shower more than 1 hour per week. We cannot move freely around the prison like other inmates, we have to walk close to the walls. We cannot communicate with other prisoners, only in our circle of about 60 people, which is 5 to 10% of the total inmates. We face a lot of problems and bullying! By the end of this year, at the request of the European Commission, Moldova must strengthen the protection of human rights, especially among vulnerable groups, eliminate the weaknesses in the judicial system identified by the Council of Europe and increase the participation of civil society in the decision making at all levels. As a vulnerable group, we ask our government to: 1. Eliminate, recognizing it unconstitutional, the law 22.03.2013 n. 43, which violates article 16 of the Constitution regarding the equality of citizens before the law. The amnesty should apply to all categories of prisoners, in particular those who were minors at the time of the crime, as well as to the sick and people over the age of 60. Every convict, regardless of the type of crime, should also have the possibility of pardon, at least for the under 21, for the sick and for the over 50. 2. The elimination of law 272/2018 in part 5 of article 473, paragraph 2 of the Code of Criminal Procedure, which will ensure equality in the reduction of penalties due to inhumane conditions of detention. 3. Elimination of Law 371/2006, which violates Part 2 of Article 10 of the International Convention on the Transfer of Sentenced Persons, Part 2 of Article 4 of the Constitution of the Republic of Moldova and part 2 of article 557 of the Criminal Procedure Code of the Republic of Moldova, which prevents foreign prisoners from being transferred to their countries because they are gay friendly by having more humane legislation, as in the case of Norwegian citizen Oleg Sivitski. 4. Remove the hierarchy (caste) from prisons. 5. Only the behavior of the detainee should be considered when considering early release, not his crime category or sexual orientation. 6. To achieve the humanization of criminal legislation, as was done in Romania in 2009. Moldova is feared to be proud of its criminal laws, generously awarding sentences where the degree of punishment does not match the seriousness of the crime.
